Indonesia\u2019s second largest palm oil company faces longstanding allegations of land grabbing, intimidation and criminalization of Human\u00a0 Rights Defenders, and permitting irregularities\u00a0<\/i><\/strong><\/p>\n

 <\/p>\n

JAKARTA\/WASHINGTON <\/b>\u2013 Friends of the Earth groups and TuK INDONESIA condemn the\u00a0 recent decision by the Roundtable on Sustainable Palm Oil (RSPO) to grant membership to\u00a0 Astra Agro Lestari (AAL) while impacted communities in Sulawesi <\/span>report <\/span><\/a>regular protests,\u00a0 occupation of contested land, criminalization of rightsholders, violent clashes between security\u00a0 officers and villagers, and the threatening presence of <\/span>paramilitary forces<\/span><\/a>. For years,\u00a0 communities have <\/span>asserted <\/span><\/a>their land was taken without their consent, their waterways\u00a0 degraded, and that AAL subsidiaries are operating without the proper legal permits.\u00a0\u00a0<\/span><\/p>\n

\u201cThe main cause for land conflicts in Sulawesi is AAL\u2019s failure to obtain the Free, Prior and\u00a0 Informed, Consent of rightsholders to operate on their lands,\u201d says <\/span>Uli Arta Siagian, Campaign\u00a0 Coordinator for WALHI\/Friends of the Earth Indonesia. <\/b>\u201cAAL has not demonstrated that its\u00a0 subsidiaries have ever received FPIC. Yet the right to FPIC is supposed to be a central\u00a0 requirement of RSPO Principles and Criteria, as is respect for human rights, including the rights\u00a0 of Human Rights Defenders.\u201d\u00a0\u00a0<\/span><\/p>\n

The RSPO\u2019s decision comes at a time when toxic haze from the <\/span>worst fires in over a decade in <\/span>\u00a0<\/span>Indonesia <\/span><\/a>\u2013 largely caused by the clearance of land for palm oil plantations \u2013 has enveloped the\u00a0 region, causing over <\/span>280,000 cases <\/span><\/a>of respiratory illness and prompting a <\/span>class-action lawsuit <\/span><\/a>against the Indonesian government.\u00a0\u00a0<\/span><\/p>\n

In 2024, AAL announced its application, spurring <\/span>public calls <\/span><\/a>from Indonesian and international\u00a0 civil society for the RSPO to withhold membership. Since allegations of environmental and\u00a0 human rights harms have been documented, ten consumer goods companies \u2013 Colgate Palmolive, Danone, FrieslandCampina, Hershey\u2019s, L\u2019Oreal, Mondelez, Nestle, PepsiCo, and\u00a0 Procter & Gamble \u2013 all RSPO members, have <\/span>suspended <\/span><\/a>palm oil sourcing from AAL.\u00a0 Numerous investors and pension funds have <\/span>excluded financing <\/span><\/a>to AAL and its parent\u00a0 companies Jardine Matheson and Astra International. The United Nations has also raised\u00a0 concerns about environmental and human rights impacts with <\/span>A<\/span>AL<\/span><\/a>, <\/span>Jardine Matheson<\/span><\/a>, <\/span>A<\/span>stra <\/span>\u00a0<\/span>Internationa<\/span><\/a>l, and the <\/span>Government of Indonesia<\/span><\/a>.\u00a0<\/span><\/p>\n

AAL\u2019s sister company PT Agincourt Resources, another member of the Jardine Matheson\u00a0 Group, is embroiled in controversy around its operations of the Martabe Gold Mine in Sumatra.\u00a0 According to <\/span>media reports<\/span><\/a>, the company\u2019s operations are linked to deforestation, watershed\u00a0 instability, and threats to the survival of the critically endangered Tapanuli orangutan. Following\u00a0 <\/span>deadly <\/span><\/a>floods in Sumatra in November 2025 that killed over 1,110 people and 11 percent of the\u00a0 Tapanuli orangutan population, the Indonesian government <\/span>revoked <\/span><\/a>the permit of PT Agincourt\u00a0 Resources only to allow the company to <\/span>resume mining operations <\/span><\/a>in April 2026. According to\u00a0 <\/span>Forests & Finance<\/span><\/a>, since 2016 some of the largest financiers in the Jardine Matheson Group,\u00a0 which includes AAL and PT Agincourt Resources, are Bank Mandiri, Bank of China, Bank Panin,\u00a0 BlackRock, Mitsubishi UFJ Financial, Mizuho Financial, Oversea-Chinese Banking Corporation,\u00a0 SMBC and Vanguard.\u00a0\u00a0<\/span><\/p>\n

\u201cThe RSPO\u2019s decision to grant membership to AAL is further evidence that destructive\u00a0 companies can use the body to hide from accountability,\u201d says <\/span>Gaurav Madan, Senior Forests\u00a0 and Land Rights Campaigner at Friends of the Earth US<\/b>. \u201cAs the devastating impacts of the\u00a0 climate crisis are felt with increasing intensity, the RSPO presents a fa\u00e7ade of responsibility\u00a0 while environmental and human rights abuses persist. AAL\u2019s membership in the RSPO is\u00a0 another step toward greenwashing conflict palm oil. Consumer brands and investors that have\u00a0 sanctioned AAL and its parent companies should conduct independent due diligence and push\u00a0 for meaningful remedy for impacted communities.\u201d\u00a0<\/span><\/p>\n

Numerous studies have shown the RSPO\u2019s inadequacy in addressing deforestation,\u00a0 environmental degradation, and human rights abuse. These include findings that <\/span>systemic and <\/span>\u00a0<\/span>widespread <\/span><\/a>non-adherence to RSPO standards contributes to ongoing land conflicts, labor\u00a0 abuses, and forest destruction; that there is <\/span>no difference <\/span><\/a>between plantations certified by the\u00a0 RSPO versus those not certified in terms of environmental and social sustainability; and that <\/span>the <\/span>\u00a0<\/span>RSPO\u2019s compliance <\/span>system is <\/span>ineffective <\/span><\/a>and <\/span>fails <\/span><\/a>to enforce sanctions, allowing members to\u00a0 evade consequences.\u00a0<\/span><\/p>\n

\u201cGranting AAL RSPO membership exposes the body’s fundamental failure as a sustainability\u00a0 mechanism,\u201d <\/span>says Linda Rosalina, Executive Director of TuK INDONESIA<\/b>. \u201cFinanciers\u00a0 should not rely on RSPO membership to justify continued financing of companies driving\u00a0 environmental destruction and human rights abuses. Certification is not a justification for abuse.\u00a0 Indonesian banks such as Bank Mandiri should comply with Indonesia\u2019s prudential banking\u00a0 principle and be held accountable for their role in financing AAL\u2019s abuses.\u201d\u00a0\u00a0<\/span><\/p>\n

In 2024, TuK INDONESIA filed a <\/span>lawsuit <\/span><\/a>against Bank Mandiri over its financing of AAL for\u00a0 violating its environmental, social, and governance commitments. The case has been\u00a0 recommended for judicial review by Indonesia\u2019s Supreme Court.\u00a0<\/span><\/p>\n

The RSPO\u2019s decision to grant AAL membership isn\u2019t the only recent instance where the RSPO\u2019s\u00a0 flawed logic is on display.\u00a0<\/span><\/p>\n

In Liberia, the RSPO recently <\/span>lifted a stop-work order <\/span><\/a>on another palm oil company \u2013 Golden\u00a0 Veroleum Liberia (GVL). In 2018, the RSPO <\/span>found <\/span><\/a>that GVL coerced and intimidated\u00a0 rightsholders into signing agreements with the company, didn\u2019t receive FPIC from impacted\u00a0 communities, and destroyed local sacred sites. A few years later, another international body \u2013\u00a0<\/span><\/p>\n

the High Carbon Stock Approach \u2013 <\/span>concluded <\/span><\/a>that GVL had destroyed 1,000 hectares of\u00a0 Liberia\u2019s Upper Guinea forest \u2013 a globally-significant ecosystem home to local communities and\u00a0 endangered chimpanzees. Last year the RSPO lifted the stop-work order it had placed on GVL\u00a0 \u2013 despite the company failing to fulfill the terms of the RSPO\u2019s decision, sparking <\/span>international <\/span>\u00a0<\/span>condemnation<\/span><\/a>. Earlier this year a <\/span>formal complaint <\/span><\/a>was filed against GVL with Liberia\u2019s\u00a0 Environmental Protection Agency alleging the failures of voluntary corporate mechanisms.<\/span><\/p>\n
